1. The Company

These terms govern the relationship between you (“the client”) and Babasails Yachting | Halkidiki Sailing, operated by Cpt. Simon Ziogou, based in Thessaloniki, Greece.

2. Bookings & Confirmation

• A booking is confirmed once payment has been received and a written confirmation is sent to your email.
• By completing a booking, you accept these Terms & Conditions for yourself and all passengers.
• You are responsible for ensuring all passengers in your group are aware of and comply with these terms.

3. Capacity & Passengers

• Catamaran: maximum 12 passengers
• Sailing Yachts: maximum 11 passengers
• Children under 18 must be accompanied by a parent or legal guardian at all times.
• We reserve the right to refuse boarding to any passenger who appears intoxicated to a degree that poses a safety risk to themselves or others on board.

4. Cancellation & Refund Policy

Cancellation by the client:

• More than 14 days before departure: Full refund or free rescheduling
• 7–14 days before departure: 50% refund or free rescheduling (subject to availability)
• Less than 7 days before departure: No refund. Rescheduling at our discretion.

All cancellation requests must be submitted in writing to [email protected].

Cancellation by Halkidiki Sailing:

• We reserve the right to cancel or modify a cruise due to adverse weather conditions, mechanical issues, or circumstances beyond our control (force majeure).
• In such cases, clients will be offered a full refund or a free rescheduling on an alternative date.
• We are not liable for any additional costs incurred (flights, accommodation, etc.).

5. Weather & Safety

• The captain’s decision regarding departure, route, and return is final and made solely on grounds of passenger safety.
• In the event of unforeseen weather deterioration during the cruise, the captain reserves the right to alter the route or return to port early.
• Partial refunds may be offered at the captain’s discretion for significantly shortened cruises due to weather.

6. Passenger Responsibilities

• Passengers must follow all safety instructions given by the captain and crew at all times.
• Life jackets are available on board and must be worn when instructed by the captain.
• Passengers swim at their own risk. Swimming is only permitted when expressly permitted by the captain.
• Passengers are responsible for their personal belongings. Halkidiki Sailing is not liable for loss or damage to personal items.
• Any damage to the vessel caused by a passenger’s negligence or misconduct may be charged to the responsible party.

7. Health & Medical Conditions

• Passengers with medical conditions that may be affected by sea travel (seasickness, heart conditions, mobility issues, pregnancy, etc.) should consult their doctor before booking and inform us prior to departure.
• We reserve the right to deny boarding if we believe a passenger’s condition poses a safety risk on board.

8. What’s Included / Not Included

Inclusions vary by cruise type and are clearly stated on each product page. Unless explicitly stated, the following are not included: alcoholic beverages, restaurant meals ashore, transport to/from the marina, travel insurance.

9. Photography & Social Media

We may photograph or film during cruises for promotional use on our website and social media. If you prefer not to be photographed, please inform the captain before departure. By not opting out, you consent to your image being used for promotional purposes.

10. Limitation of Liability

Halkidiki Sailing — Babasails Yachting shall not be liable for any indirect, consequential, or incidental damages arising from the use of our services, beyond the value of the booking paid. Our liability for personal injury is governed by applicable Greek maritime law.

11. Governing Law

These Terms & Conditions are governed by the laws of Greece. Any disputes shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, Greece.
